Definition
- Sexual harassment is unwelcome conduct of a sexual nature, which is prohibited both by Title VII of the Civil Rights Act of 1964 as it applies to employees and Title IX of the Educational Amendments of 1972 when dealing with students. The genesis of sexual harassment legislation was to forbid employers from hiring and promoting employees on the basis of their gender and to prohibit the conditioning of employment in return for sexual favors.The Law and its EnforcementAccording to Title VII of the Civil Rights Act of 1964, public school boards and nonpublic schools with more than 15 employees that receive federal financial assistance may be liable for sexual harassment claims.
