Definition
- Bail regulations in the United States were originally based on English laws that developed in reaction to the misuse of bail. Laws since the Eighth Amendment provision against “excessive bail” have incorporated both provisions for nonfinancial bail that will ensure more people are able to be released and a concern for community safety that will prevent some people from being released.
