  • Two primary questions must be considered when addressing the complex concept of the criminal prosecution of terrorists. The first is definitional: What is a terrorist act or, for that matter, a terrorist? Once a determination has been made that an individual, group, or act can be so defined, the second question arises: What laws exist, at both the national and international levels, that would be applicable to any prosecutorial effort?
