  • Freedom of religion is basic to the American concept of liberty. The First Amendment protects religious freedom with two distinct clauses: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” The Supreme Court applied the Free Exercise Clause to the states in 1940 and the Establishment Clause in 1947.
