Definition

  • The term inevitable discovery denotes an exception to the exclusionary rule for illegally obtained evidence that would have been discovered by legal means anyway. Under the exclusionary rule, evidence obtained in violation of the Constitution cannot be used at trial against the person or persons whose constitutional rights were violated.
