Definition

  • Equal Protection clauses prohibit governments from treating people differently based upon factors such as race, religion, or gender. The U.S. Constitution's Fourteenth Amendment and similar clauses in state constitutions prohibit states from denying equal protection of “the laws,” while the Fifth Amendment's due process clause prohibits the federal government from “invidiously” (unfairly) discriminating.
