  • Commercial speech—that is, advertising or other speech proposing a commercial transaction—was once considered unprotected by the First Amendment and therefore subject to regulation or even prohibition by Congress or the states. In a series of decisions beginning in the 1970s, however, the Supreme Court extended constitutional protection to commercial speech, first tentatively and then more broadly.
