- Although the Fourth Amendment does not specifically address the issue of searches by night, there is considerable precedent suggesting that the bar is higher for executing searches at night than during daylight hours. The most obvious reason for this, especially in the case of searches of private dwellings, is that individuals are more likely to be in a state of undress and generally have a greater expectation of privacy in their homes during the night than during daylight hours.
