particularity requirement
Definición
- The particularity requirement of the Fourth Amendment provides that a search warrant should particularly describe the “place to be searched, and the persons or things to be seized.” The requirement ensures that government officials do not engage in fishing expeditions or use general warrants, in the quest to find contraband. Contraband that is gathered through such means will be subject to the exclusionary rule, which prohibits the use of such evidence at trials.
