  • Courts have established that the Fourth Amendment does not require warrants for searches to which an individual who owns the property gives consent, but courts have had greater difficulty ascertaining the appropriateness of searches to which another individual, a third party, has given consent. As a general rule, landlords or owners of hotels and motels cannot give consent to warrantless searches of property that others are renting from them, although they may be able to give such consent to searches of property that have been vacated or abandoned by former tenants.
