- The U.S. Supreme Court has consistently distinguished between searches and seizures conducted for the purpose of gathering evidence for criminal prosecutions and more routine administrative searches that are directed at protecting public health and safety. It has typically done so either by allowing a system of regulatory statutes limiting executive discretion to substitute for warrants, as in Colonnade Catering Co.
