  • Marriage and divorce law in the United States is almost entirely governed by state law, which means that there has been divergence among the states on matters involving the criteria for a valid marriage and the grounds for divorce. In the late 19th and early 20th centuries, the grounds for divorce ranged from no divorce at all in some states to a variety of fault-based grounds in others to no-fault in others, each setting its own residency requirements or other procedural requirements for the filing of a divorce action.
