Frank doctrine  

Définition

  • The Frank doctrine holds that the warrant requirement of the Fourth Amendment does not apply to certain administrative searches—searches by public officials for reasons other than enforcing the criminal law. The doctrine originated in Frank v. Maryland (1959), in which the U.S. Supreme Court affirmed Aaron Frank's conviction and the imposition of a fine for his refusing to allow a city health inspector to enter his home without a warrant.
