Définition

  • Qualified immunity (QI) is a rule created by the U.S. Supreme Court to protect government officials from liability for many of their actions. It allows public officials who are sued to avoid civil trial by getting a pretrial dismissal by establishing that they were carrying out a discretionary act, within the scope of their employment, and that the act was done in objective good faith.
