- The doctrine of the fruit of the poisonous tree is inextricably intertwined with the exclusionary rule. The latter is a rule by which judges preclude police from using evidence that they have gathered in knowing or reckless disregard for Fourth, Fifth, Sixth, and Eighth Amendment standards.
