- Most civil divorces today require the division of marital property from jointly held, or jointly acquired, to individual ownership. When courts of law supervise the division of property, it is usually necessary to distinguish between property that was owned individually by the parties before marriage (separate property) and property that was acquired during the marriage (marital property).
