  • The “separate but equal” doctrine was the legal underpinning of the U.S. system of racial segregation. Born in the period when Whites regained control of the South after the Reconstruction era, segregation was the law of the land for many years, operating under a U.S. Supreme Court finding that separate but equal facilities were legal.
